DiFrancesco Bateman’s land use and redevelopment department consists of experienced attorneys who represent real estate developers, property owners, non-profit entities, along with municipal, State, and county entities in connection with all phases of land use approvals. The department handles a variety of residential, commercial, industrial, and institutional projects: from minor residential variance applications, to major residential subdivisions, to complex commercial developments. The department’s legal representation is at all governmental levels, as well as litigation and appeals involving the approval and permitting process and redevelopment.
Having the experience in representing municipalities and land use boards, we can provide a unique insight into a wide range of land use matters, including site plans, subdivisions, variances, rezoning, redevelopment and affordable housing developments from the prospective of the developer and the municipality. We assist our broad client base from the initial concept designs, through the land use approval process, to post approval compliance, including negotiation of developer’s agreements, easements and the permitting process.
The department has a dynamic land use litigation practice, which includes appeals of decisions of planning and zoning boards of adjustment and other governmental agencies; challenges to zoning ordinances and regulations; and appeals of State agency determinations. The department coordinates internally with our colleagues throughout the Firm on matters such as transactions, leasing, construction agreements, and litigation, so that clients obtain full representation for all their needs.
