Siting Wireless Facilities in the Municipal Right-of-Way

Ed PurcellEdward Purcell, Esq. will be speaking at a seminar during the 102nd New Jersey State League of Municipalities Conference on issues related to the siting of wireless facilities in the municipal right-of-way. Recently, New Jersey municipalities have been confronted with applicants seeking to place wireless facilities, called small cells, in their rights-of-way. In fact, some municipalities have even been confronted with applicants seeking to place 120 foot monopoles in their rights-of-way. How towns handle these requests will impact how future requests are dealt with. This is an area of law that involves federal law, state law and a warren of issues related to zoning and fee recovery. If your town is confronting this issue, you should consider putting this seminar on your calendar.
