The DiFrancesco Bateman Employment Practice Group represents clients in employment matters including but not limited to labor negotiations, personnel matters, litigation, and other disputes involving employment and labor matters. We provide these services for both private clients and public entities, and we are frequently retained by insurance carriers and receive direct referrals from multiple municipal/governmental and corporate entities throughout the State. Our clients are involved in many fields, including research and development, high technology, pharmaceuticals, banking and finance, construction, education, service oriented businesses, non-profit agencies, and municipal and governmental entities. We have extensive experience in handling claims based upon discrimination/harassment, retaliation, hostile work environment, employment at will, wrongful discharge, discrimination on the basis of age, sex, race, national origin, religion, disability, sexual orientation and other protected characteristics, as well as employee benefits and labor relations in Federal and State Courts and before administrative agencies.
Members of the Employment Group have more than 20 years’ experience in providing legal services to municipalities in a broad spectrum of labor issues. This includes but is not limited to providing training to supervisors and employees related to labor issues in the workplace, engaging in day-to-day activities related to personnel matters, representing clients in disciplinary hearings, including civil service entities, representing clients in both labor and special litigation matters and representing clients in negotiations with bargaining units. The Employment Group’s members stay abreast of all recent developments in labor and employment law.
Labor negotiations have been performed by the firm for the Police Department, Teamsters, Communication Workers of America, and the Police Dispatchers of Warren Township for the past 25 years. The firm has negotiated labor contracts for the Union County Utilities Authority, and multiple unions in the Township of Edison and Somerset County. We have appeared in the Administrative Law Courts on many occasions on labor-related issues. In addition, a major portion of our daily legal activity is giving labor advice to our numerous private and municipal clients.
The Employment Group has significant experience litigating matters involving claims alleging discrimination in the workplace, including but not limited to claims alleging violations of the New Jersey Law Against Discrimination (NJLAD), the New Jersey Conscientious Employee Protection Act (CEPA), Title VII of the Civil Rights Act of 1964, the Americans With Disabilities Act (ADA), and the Family Medical Leave Act (NJFLA).
