The Construction Group provides advice and guidance to our clients at all phases of a construction project; from the initial contract, application to local zoning and planning boards, agreements with contractors and suppliers, to the final approvals and certificates of occupancy. DiFrancesco Bateman has significant success in representing owners, general contractors, subcontractors and suppliers in all aspects of litigation and arbitration that arise out of the construction process, including the filing and prosecution of construction lien and municipal lien claims, bond claims, Miller Act claims, scope of work claims, change order issues, contract balance claims, acceleration and delay claims, and defective workmanship/negligent design claims.

The DiFrancesco Bateman Construction Group is also experienced in advocating for clients in disputes that arise out of the construction process, including scope of work issues, construction defect and negligent design claims. We have represented owners/developers, design professionals (architects and engineers), contractors, subcontractors, construction managers and material suppliers in federal and state litigation.

Our attorneys have extensive experience in representing clients involved in both construction defect issues and personal injury claims asserted as a result of negligent acts or omissions or violations of statutory obligations on construction projects. We have been involved in wrongful death and high exposure claims involving construction-related accidents of employees and third parties, as well as claims related to defective construction materials, including EIFS and Chinese Drywall. We regularly represent architects and engineers in claims relative to wrongful acts and errors or omissions arising from professional services rendered on large- and small-scale construction projects.

When we are retained to defend litigation, our approach is aimed at the early identification of key issues and is predicated on developing defense strategies tailored to the individual case and client. The application of this strategy is carried out by a team consisting of experienced partners, associates and paralegals involved in all aspects of construction projects and litigation.
