Lisa Fittipaldi Obtains Favorable Decisions for School Board Clients in Two Matters

Lisa M Fittipaldi, Esq., a Member of the Firm in the Employment and School Law practice groups, was successful in two recent matters on behalf of school board clients. Lisa obtained summary judgment resulting in dismissal of a case where the Plaintiff claimed bullying took place without intervention by the school. Although courts are generally reluctant to grant summary judgment in matters, Lisa persuaded the court to dismiss the case by demonstrating that the school responded to the problems and took action to stop the conduct from continuing.

In another matter Lisa was also successful on an appeal of a decision of an arbitrator in a teacher disciplinary matter. The arbitrator had found no evidence of misconduct by the teacher despite video tape evidence and eye witness testimony. On appeal, the Court was persuaded by Lisa’s arguments finding the arbitrator imperfectly executed his powers and overturned the award.
