GOVERNOR SIGNS LAW SUPPLEMENTING NEW JERSEY FAMILY LEAVE ACT DURING STATE OF EMERGENCY

In the continuing effort to address the economic effects of COVID-19, Governor Murphy recently signed Senate Bill 2374 which modifies the NJ Family Leave Act. The new law permits an employee to take family leave as a consequence of the governor declaring a state of emergency, or when the Commissioner of Health or other public health authority requires actions to be taken due to an epidemic of a communicable disease, such as we are facing at the present time. Under these circumstances, an employee is permitted to take family leave to care for children when schools are closed, care for family members as a result of mandatory quarantine or as required by a health care provider.  There is no provision in the statute that permits a person to elect not to go to work and be eligible for family leave because of fear of contracting the virus. The revisions contain specific provisions pertaining to certifications from health care providers, and addressing employer responsibilities.
