NJ Law Against Discrimination Amended to Provide Additional Protections to Pregnant Women

On January 21, 2014, New Jersey Gov. Chris Christie signed into law an amendment to the New Jersey Law Against Discrimination (LAD) which provides additional protections for pregnant women. The law adds a stipulation not typically found in pregnancy discrimination laws in other states. The amendment addresses “normal” pregnancy, as well as the normal language around discrimination in hiring or terms and conditions of employment. Based upon this amendment employers need to be very careful in what companies/managers say and how they treat women with normal pregnancies as failure to appreciate the need for even small accommodations like rest periods will result in complaints and ultimately lawsuits. The bottom line is that New Jersey employers should review their handbooks, equal employment opportunity, reasonable accommodation and leave policies, as well as related training materials, to ensure pregnancy is listed as a protected class and, most importantly, it is important to make sure that managers and supervisors are trained on what to look for and how to respond.
